That the murder of the Armenians was planned by the Kaiser is evident by the methods employed. The Turks at first refused, but because of their democratic principles and life the Armenians stood between the Kaiser and the realization of his scheme of an empire stretching from Hamburg to the Persian Gulf. So long as they occupied the position they did in the Turkish empire, so long would the Kaiser's plans fail. So he ordered their extermination and Turkey was the weapon used for their destruction. Article 227 of the Versailles treaty required the handing over of Kaiser Wilhelm for trial 'for supreme offence against international treaties and the sanctity of treaties' before a bench of five allied judges – one British, one American, one French, one Italian, and one Japanese. If found guilty the judges were to 'fix such punishment which it considers should be imposed'. The death penalty was therefore not precluded.
